HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 32996 of 2015 ORDER:
Heard learned Counsel for the petitioner and learned Standing Counsel for the
respondents.
The petitioner is a Granites cutting and polishing Unit situated in Odayaram Village, Gangadhara Mandal, Karimangar District. The petitioner secured electricity service connection bearing No.KRN-436 with connected load of 280 HP under H.T.-I (Industrial) service with CMD 220 KVA. The petitioner unit was not running for some time and there were dues of electricity charges to the tune of Rs.21,37,857/- by the end of June, 2015. The petitioner was given an opportunity to pay the said amount in three installments by order dated 18.08.2015. Accordingly the petitioner paid the amount immediately to the tune of Rs.7,60,000/- and the second installment was due by 19.09.2015 under which the amount required to be paid is Rs.7,63,000/-. When the petitioner did not pay the said amount, electricity supply was disconnected.
In those circumstances, the present Writ Petition is filed. The learned Counsel for the petitioner submits that the third installment is due by 19.10.2015 and that he will clear of all outstanding due amounts by 19.10.2015 and restoration of power supply may be ordered as it is necessary for clearing of these dues also.
In the circumstances, the respondents are directed to restore the power supply to the petitioner as and when the petitioner pays an amount of Rs.5,00,000/- (Rupees five lakhs only) with an undertaking that the petitioner would pay the entire balance amount by 19.10.2015.
Subject to the above, the Writ Petition is disposed of at the admission stage. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs. --------------------------------------------------- JUSTICE A. RAMALINGESWARA RAO
