HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.8483 of 2005 ORDER:

This writ petition is filed for the following substantive relief: "....to declare the impugned order No.C-18018/3/03-PE-1, dated 8.10.2004 as illegal, arbitrary, improper and discriminatory apart from violative of Articles 14 and 16 of the Constitution of India and consequently direct the respondents to extend the pensionary benefits to Visakhapatnam Dock Labour Board Employees who are similarly situate on par with the Visakhapatnam Port Trust employees as per Clause 34.2 of the Wage Settlement dt.2.8.2000."

The learned counsel for the petitioner-Association contends that this matter is squarely covered by the orders of this Court in W.P.No.21335 of 2002, dated 25.10.2018.

In view of the same, for the reasons recorded in the order dated 25.10.2018 in W.P.No.21335 of 2002, this writ petition is also disposed of giving liberty to the petitioner to submit a representation to the respondents seeking merger of the benefits with pension benefits, and on such representation being filed, the respondents shall consider the same and pass appropriate orders thereon, in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. With the above observations, the writ petition is disposed of. No order as to costs.
