THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.13981 of 2015 ORDER:
This Criminal Petition is filed by the petitioner - accused No.12 under Sections 437 and 439 Cr.P.C. seeking bail in Crime No.130 of 2015 on the file of Chittoor I-Town Police Station, Chittoor District, registered for the offences punishable under Sections 302, 307, 120-B and 301 r/w. 511 and r/w.34 IPC and 25-1(b) and 27 of Indian Arms Act.
Heard and perused the material available on record. The allegation against the petitioner is that he involved in the commission of murder of Mayor of Chittoor Municipal Corporation Smt. Anuradha and her husband Katari Mohan.
Learned counsel for the petitioner submitted that the petitioner is no way concerned with the offences alleged against him and he is a practicing Advocate and he appeared in number of cases on behalf of the deceased Katari Mohan and the police also examined him as a witness by serving notices under Section 160 Cr.P.C., and the police arrested him on 08.12.2015 by invoking provision under Section 120-B IPC.
Learned Public Prosecutor has strongly objected for granting bail to the petitioner by submitting that the petitioner was arrested only on 08.12.2015 and prior to his arrest, he was thoroughly interrogated by the police by issuing notices under Section 160 Cr.P.C., on 21.11.2015 and 29.11.2015.
He further submitted that the Investigating Agency has not taken any hasty decision in arresting the petitioner and after collecting evidence, more particularly, the statement of LW.40 and also the confessional statements of six accused, the petitioner was added as an accused and that the
Investigating Agency need more time to complete the investigation and the custodial interrogation is necessary in this matter. Considering the submissions of the learned Public Prosecutor, this Court is of the view that grant of bail to the petitioner at this stage would certainly cause prejudice to the further investigation of the case. Hence, this Court is not inclined to grant bail to the petitioner. Accordingly, the Criminal Petition is dismissed. ______________ RAJA ELANGO, J January 20, 2016.
