THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.15419 of 2003 ORDER:

When the matter is taken up for hearing, none appears for the petitioner, inspite of listing the matter under the caption 'for dismissal'.

A perusal of the record discloses that the petitioner is seeking compassionate appointment, as the father of the petitioner had expired while he was discharging his duties with the 2nd respondent institution.

Learned Standing counsel appearing for respondents 2 and 3 had contended that there is no scheme for compassionate appointment. However, in lieu of compassionate appointment as per the policy of respondents 2 and 3, additional monetary benefit of Rs.34,197/- will be given, if the petitioner is entitled to. When the said amount was offered to the petitioner vide proceedings dated 19.06.2003, petitioner declined to accept the same. He further contends that the respondents are willing to disburse an amount of Rs.34,197/- to the petitioner, in lieu of compassionate appointment.

This Court after considering the rival submissions of both the parties, is of the considered view that this Writ Petition can be disposed of directing the respondents to pay the petitioner an amount of Rs.34,197/- as additional monetary benefit in lieu of compassionate appointment within four weeks from the date of

receipt of copy of this order. This Court cannot give a direction to the 2nd respondent to consider the case of the petitioner for compassionate appointment as there is no scheme in the 2nd respondent institution.

With the above observations, Writ Petition is disposed of. There shall be no order as to costs.
