THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.3681 OF 2017 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed seeking to declare the action of the respondents 2 and 3 in entertaining the application submitted by the 5th respondent for grant of quarry lease in respect of 2.00 hectares in Sy. No.526A/ 1C (526/ C) at Uppamagullur village, Ballikuruva Mandal, Prakasam District, which is the subject matter of the revision filed by the petitioner pending on the file of 1st respondent and covered by the order, dated 22.02.2013, passed in WP No.40193 of 2012, as illegal and arbitrary, and consequently, direct the respondents 2 and 3 not to process the 5th respondent's application for grant of mining quarrying operations in respect of the above land.
Heard and perused the material available on record. After arguing the matter at length, learned counsel for the petitioner restricted his prayer only to the extent to direct the 1st respondent to consider the revision filed by the petitioner, as expeditiously as possible.
Considering the submission of the learned counsel for the petitioner, without expressing any opinion on merits, this Court is inclined to pass the following order:
The Writ Petition is disposed of directing the 1st respondent to consider the revision preferred by the petitioner, as expeditiously as possible, preferably within a period of three (3) months from the date of receipt of a copy of this order.
Miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ______________ RAJA ELANGO, J June 12, 2017 KTL
