THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 1870 of 2017 ORDER:

This writ petition was filed challenging the inaction of respondent No.3-Station House Officer, Punganur Police Station, Chittoor District, in registering criminal case against respondent Nos.4 to 7 for their highhanded, illegal and unlawful acts against the petitioner and his parents.

Learned Government Pleader for Home, on the basis of written instructions, submits that though a complaint was received by registered post on 22.11.2016 against respondent Nos.4 to 7, it does not contain the original signature. Respondent No.3 tried to secure the presence of the petitioner to get the original signed copy at the given address, but he was not available. It is stated that if the petitioner approaches the police station, necessary action would be taken as per law. The petitioner was involved in Crime No.167 of 2016, dated 09.10.2016, for the offences punishable under Section 498-A I.P.C. and Sections 3 and 4 of the Dowry Prohibition Act on the file of respondent No.3. The case is pending trial in C.C.No.525 of 2016 before the Judicial Magistrate of First Class, Punganur, Chittoor District.

In view of the above, learned counsel for the petitioner requests this Court to give liberty to the petitioner to approach respondent No.3 along with original complaint in order to enable the police to take further action in accordance with law.

By granting aforestated liberty to the petitioner, the writ petition is closed.

Miscellaneous petitions, if any, pending in this writ petition shall also stand closed. There shall be no order as to costs. ________________________ A.RAMALINGESWARA RAO,J Dt:06.02.2017 kdl
