SKS, J 15.04.2026 I.A.No.1 of 2026 This Interlocutory Application is filed seeking enlargement of the petitioner-accused on interim bail for a period of three months by suspending the sentence imposed vide judgment dated 16.09.2025 in S.C. No.77 of 2023 passed by the learned Principal Sessions Judge, Bhadradri Kothagudem, wherein the petitioner was found guilty for the offence punishable under Section 304 Part-II of IPC and was sentenced to undergo rigorous imprisonment for a period of 10 years and to pay a fine of Rs.1,000/- and in default of payment of fine, to undergo simple imprisonment for a period of two months.
Heard Sri P.Prabhakar Reddy, learned counsel appearing on behalf of the petitioner as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent-State.
Learned counsel for the petitioner submitted that the petitioner is presently in judicial custody and that his mother is suffering from nasal polyps, polymenorrhea, and uterine infection. He further
submitted that the doctor attending on the petitioner's mother has advised that she undergo surgery at the earliest to prevent further complications. He further contended that there is no other person available to take care of the petitioner's ailing mother and that the presence of the petitioner is absolutely necessary to ensure proper medical treatment and care. Hence, he prayed the Court to grant interim bail to the petitioner.
Learned Additional Public Prosecutor, on instructions, has not opposed the prayer for grant of interim bail to the petitioner in order to enable him to attend to his ailing mother.
Having considered the submissions made by both sides, and in view of the medical condition of the petitioner's mother, who is suffering from nasal polyps, polymenorrhea, and uterine infection and requires immediate surgical intervention, this Court is inclined to grant interim bail to the petitioner for a period of three months.
Therefore, the petitioner shall be released on interim bail for the period from 16.04.2026 to 16.07.2026, subject to his executing a personal bond for a sum of Rs.25,000/- (Rupees TwentyFive Thousand only) with two sureties for a like sum each to the satisfaction of the concerned Jail Superintendent. The petitioner shall surrender before the concerned Jail Superintendent on
17.07.2026 without fail. The petitioner shall abide by the conditions stipulated under Section 437(3) of the Code of Criminal Procedure (presently Section 480(3) of the Bharatiya Nagarik Suraksha Sanhita). The concerned Jail Superintendent is directed to ensure that this order is complied with forthwith. The Registry is directed to communicate this order to the concerned Jail Superintendent. Accordingly, this interlocutory application is allowed.
During the period of bail, the petitioner shall not indulge in any criminal acts, failing which the respondent - State shall be at liberty to file a petition for cancellation of bail.
