HON'BLE SRI JUSTICE R.SUBHASH REDDY CIVIL REVISION PETITION No.4698 of 2015 ORDER :

This Civil Revision Petition, under Section 115 of C.P.C., is filed by the petitioner/respondent No.2, aggrieved by the order dated 26.03.2015 in E.A.No.127 of 2014 in E.P.No.10 of 2014 in O.S.No.519 of 2010 passed by the III Additional Chief Judge, City Civil Court, Hyderabad, directing for attachment of his salary. 2 . Learned counsel for the petitioner submits that though the petitioner has filed appearance in the aforesaid E.A.No.127 of 2014, he has not filed any counter affidavit and the impugned order is passed on 26.03.2015.

3. Since it is represented that the petitioner has already filed appearance, he can as well file his counter and seek for disposal of E.A.No.127 of 2014 on merits.

4 . In view of the above, this civil revision petition is disposed of permitting the petitioner to file counter in E.A.No.127 of 2014 in E.P.No.10 of 2014 in O.S.No.519 of 2010 on the file of the III Additional Chief Judge, City Civil Court, Hyderabad. If such counter is filed, E.A.No.127 of 2014 shall be disposed of as expeditiously as possible, preferably within a period of six weeks from the date of receipt of a copy of this order.

5. As a sequel, miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
