THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION NO.24964 OF 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking to issue writ of mandamus declaring the action on the part of the 2nd respondent in passing the order in proceedings No.K/7663/2016, dated 14-06-2016, suspending the authorization of the petitioner's fair price shop No.1820, Eklaspur village, Saidapur Mandal, Karimnagar District, on the very same date of issuance of show cause notice without waiting the period shown in the show cause notice to submit explanation and without indicating the period of suspension is illegal and arbitrary and consequently direct the respondents 2 and 3 to supply the commodities to the fair price shop of the petitioner.
2. The case of the petitioner is that she is a fair price shop dealer of shop No.1820, Eklaspur village, Saidapur Mandal, Karimnagar District. While so, the 2nd respondent issued the impugned order suspending the authorization of the fair shop of the petitioner basing on 6-A case report submitted by the 3rd respondent.
3. The only request made by the learned counsel for the petitioner is to direct the 2nd respondent to dispose of the disciplinary proceedings pending against the petitioner.
4. Learned Government Pleader for Civil Supplies also consented for the same.
5. Having regard to the facts and circumstances of the case, the 2nd respondent is hereby directed to dispose of the disciplinary proceedings initiated against the petitioner as early as possible preferably within a period of one month from the date of receipt of a copy of this order after affording reasonable opportunity to the petitioner to put forth her stand.
6. Accordingly, the Writ Petition is disposed of. No order as to costs. Miscellaneous petitions, if any pending, in this Writ Petition shall stand closed.
