HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.39849 OF 2016 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking to declare the inaction of the 2nd respondent in numbering and hearing the revision petition and stay petition filed by the petitioner on 07.11.2016 u/s.9 of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 (for short 'the Act'), as illegal and arbitrary. Heard the learned counsel for the petitioner as well as the learned Assistant Government Pleader for Revenue for respondents 1 to 5. With their consent, the writ petition is disposed of at the stage of admission itself. There is no necessity to put respondents 6 to 8 on notice since this Court is not venturing to adjudicate the case on merits.

The limited grievance of the petitioner in this writ petition is that he filed a revision under Section 9 of the Act on 07.11.2016 against the order dated 06.10.2016 passed by the 3rd respondent in Appeal No.A4/2111/2015, however, till date the revision is not yet numbered. Aggrieved over the same, present revision is preferred.

Learned AGP would submit that the 2nd respondent may be directed to dispose of the stay application, if it is in order, in accordance with law.

Having regard to the rival submissions made, the Writ Petition is disposed of directing the 2nd respondent-Joint Collector to number the revision said to have been filed by the petitioner on 07.11.2016 as well as the interlocutory application filed therein, if they are in order, and dispose of the stay application, in accordance with law, after hearing the petitioner and other aggrieved persons, if any, as early as possible, preferably within a period of 6-8 weeks from the date of receipt of a copy of this order. Till such time, status quo as on today in all respects shall be maintained with regard to agricultural land admeasuring Ac.1-34 gts. in survey No.227/1A/1 of Krishnajiwadi (V), Tadwai (M), Kamareddy District.

Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No order as to costs.
