THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.11462 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.5 in Crime No.1258 of 2023 on the file of Gachibowli Police Station, Cyberabad, Ranga Reddy District, registered for the offences under Section 20 (b) (ii) (C) of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act') and Section 34(a) of Telangana State Excise Act.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

This petitioner along with other accused was arrested on 25.10.2023 for being in possession of 7.5 kgs of ganja and 117 liquor bottles of various brands. Five family members were arrayed as accused in the said crime. The contraband was found in the house.

This Court by order dated 15.11.2023 in Crl.P.Nos.11200 and 11195 of 2023 has granted bail to accused Nos.2 and 4 in

the present crime and the petitioner herein also stands on the same footing. Hence, the prayer for regular bail can be considered, subject to following conditions:- i) The petitioner/Accused No.5 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties, for a like sum each to the satisfaction of the X Additional Metropolitan Magistrate at Kukatpally, Cyberabad.

ii) The petitioner/Accused No.5 after release shall appear before the concerned Station House Officer on every Monday at 10:00 a.m. for a period of four weeks and thereafter, as and when required, for the purpose of investigation.

(iii) The petitioner/Accused No.5 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
