CVNR, J SA.No.1257 of 2018 Dt:10.8.2018 JUDGMENT:

This Second Appeal is filed against the concurrent findings of fact rendered by both the Courts below. The suit-O.S.No.108 of 2004 filed by the appellants for permanent injunction was dismissed by the Principal Junior Civil Judge, Chodavaram, vide judgment, dated 05.9.2011, on finding that they were unable to prove that they are in physical possession of the suit schedule property. This finding of fact was affirmed in the appealA.S.No.7 of 2014 by the Senior Civil Judge, Chodavaram, vide judgment, dated 21.8.2017. These findings, which fall in the realm of appreciation of facts, therefore, do not give rise to any substantial question of law warranting interference of this Court in exercise of its jurisdiction under Section-100 of the Code of Civil Procedure. Hence, the Second Appeal is dismissed.
