THE HONOURABLE SRI JUSTI CE N. BALAYOGI CRI MI NAL PETI TI ON No.3 2 1 9 of 2 0 1 1 ORDER:

Sri Rama Rao, Advocate, today again sought time in the matter on the ground that the petitioners' Counsel is not well. As seen from the proceeding sheet, since beginning, none appeared for the petitioners having obtained interim stay initially for a period of eight weeks in CRLP.M.P.No.3448 of 2011, dated: 13-4-2011. That on 24.6.2011 it was directed to post the matter on 04-7-2011 at 2.15pm, under the caption of "For Orders". Further, on 04.7.2011, 08.7.2011, 13.7.2011, 15.7.2011 and 21.7.2011, there was no representation on behalf of the petitioners' Counsel. Accordingly, as per the orders dated: 21.7.2011, the petition was ordered to be posted on 22.7.2011 at 2.15pm, under the caption of "For Dismissal" in Motion List.

2.

Further, the order dated: 22.7.2011 shows that the petition was ordered to be listed on 25.7.2011 under the caption of "For Orders" in Motion List at 2.15p.m, on which date, there was no representation on behalf of the petitioners' Counsel. Again on 21.9.2017, 10.11.2017 and 22.1.2018 when there was no representation, it was directed to be posted on 29-1-2018, under the caption of "For Dismissal", on which date, petitioners' Counsel sought time. Therefore, it was directed to post on 31.1.2018, under the caption of "For Dismissal". 3.

Thus, the above version shows that since beginning the petitioners are not interested to prosecute the matter in spite of posting the matter under the caption of "For Dismissal". Even today Contd..P.2.

-2also, when the matter is listed, under the caption of "For Dismissal" request is made that petitioners' Counsel is not well which clearly go to suggest that the petitioners are not interested to prosecute the matter. Hence, under these circumstances, the Criminal Petition is dismissed for non-prosecution.

4.

Miscellaneous Petitions, if any, pending shall stand closed. __________________ JUSTICE N. BALAYOGI Dated: 31-1-2018 gnr
