O R D E R
Aggrieved by the inaction of the 3rd respondent - Station House Officer, I Town Police Station, Visakhapatnam, in not registering the crime based on the complaint of the petitioner dated 16.07.2018, against the unofficial respondents, the present writ petition is filed.
Learned Assistant Government Pleader for Home produced written instructions of the 3rd respondent stating that there is a civil dispute between the petitioners and the unofficial respondents in O.S.No.1665 of 2011, on the court of II Additional Senior Civil Judge, Visakhaptnam and the same was dismissed on 29.03.2018. Aggrieved by the same, petitioner preferred appeal and the same is pending on the file of Principal District Judge, Visakhapatnam. The 3rd petitioner gave representation dated 23.07.2018 to the 3rd respondent requesting to stop the construction undertaken by the unofficial respondents. Thereupon, entry was made in the general diary of the police station on 28.07.2017 and conducted preliminary enquiry, which revealed that matter is of purely civil in nature and the same was informed to the petitioners and they were asked to seek redressal before a competent civil court.
Learned counsel appearing for the petitioners does not dispute the same. Recording the above statement made in the written instructions, writ petition is disposed of granting liberty to the petitioners to avail alternative remedies available under law.
