THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE GUDI SEVA SHYAM PRASAD WRI T PETI TI ON No. 8911 of 2017 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) This writ petition was filed assailing the E-Auction-cum-Sale Notice dated 09.02.2017 issued by the State Bank of Hyderabad proposing to hold the auction sale of the secured asset on 14.03.2017. No interim order was granted by this Court at the initial stage. While so, Sri R.N. Hemanand, learned counsel representing Sri Ravi Kumar Mathangi, learned counsel for the petitioner, would concede that though the auction sale was conducted on 14.03.2017, no bidders participated and therefore no actual sale materialised. That being so, the challenge to the E-Auction-cum-Sale Notice dated 09.02.2017 no longer survives for consideration on merits.

The writ petition is accordingly closed on this ground leaving it open to the petitioner to avail appropriate remedies in accordance with law before the proper forum as and when fresh cause of action arises.
