HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.29882 of 2017 ORDER:
Even, as per the affidavit filed before this Court, petitioner was shown as witness in Crime No.79 of 2017 registered for the offences under Sections 447, 427 and 379 IPC, and the police are harassing him to produce the sole accused though he is not aware of the whereabouts of the accused. Hence the writ petition.
Learned Government for Home (AP), on instructions, would submit that the accused was apprehended and obtained bail and, therefore, question of police insisting the petitioner to produce the accused does not arise; the allegation is made merely on apprehension rather than without any basis; except for the purpose of recording any statement that may be required, at this stage, there is no reason for police to harass the petitioner in any manner; and denied the allegations made against police.
Having considered respective submissions, and as the respondents have categorically denied that there is any harassment of the petitioner and, considering the fact that the accused had already been apprehended and was granted bail and, in the event of the petitioner being required for the purpose of enquiry, he shall cooperate with investigation and, at the same time, he shall not be harassed by police. The Writ Petition is, accordingly, disposed of.
Miscellaneous Petitions, if any, pending shall stand closed. No order as to costs.
