HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.27858 OF 2018 O R D E R :

This writ petition is filed challenging the action of the respondent police in not investigating the Crime in FIR No.33/2018, dated 05.04.2018.

Heard learned counsel for the petitioner.

Learned Assistant Government Pleader for Home produced written instructions stating that in connection with Crime No.33/2018, LWs.1 to 5 were examined; that the case of writ petitioner was not supported by LWs 3 to 5; that basing on the same the 3rd respondent sent requisition under Questionnaire to the Civil Assistant Surgeon for getting clarification; that in turn the Civil Assistant Surgeon gave his reply to the said questionnaire on 13.08.2018; that basing on the same the 3rd respondent came to a conclusion that the complaint dated 05.04.2018 submitted by the petitioner is false; that there after sent proposal on 13.08.2018 to the Sub Divisional Police Officer, Mydukur, through proper channel, for referring the case as false; and that the same is pending. It is also stated that the 3rd respondent would file final report before the concerned court immediately after securing the referral proceedings from the Sub Divisional Officer, Mydukur.

In view of the above, it is clear that the grievance of the petitioner stood redressed as investigation is almost complete.

Hence, the 3rd respondent is directed to take appropriate steps for filing final report as expeditiously as possible by issuing notice to the petitioner. It is also open for the petitioner to avail alternate remedy as may be available to him under law.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
