SEETHARAMA MURTI WRIT PETITION No.28624 of 2016 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) The unsuccessful applicant in O.A.No.7481 of 2012 before the Andhra Pradesh Administrative Tribunal, Hyderabad, is before this Court aggrieved by the dismissal of the said O.A. by order dated 04.02.2016.
Perusal of the order under challenge reflects that the only ground on which the Tribunal refused to grant the relief to the petitioner/applicant was that there is an efficacious alternative remedy by way of an appeal against the order subjected to challenge before the Tribunal.
Without availing the said appellate remedy, the petitioner/applicant sought recourse to the Tribunal and thereafter this Court. We are of the opinion that once hierarchical remedies are provided in the statute, the same should not be circumvented unless warranted on recognised grounds. No such grounds are made out in the present case. We therefore find no reason to interfere with the exercise of discretion by the Tribunal.
The writ petition is devoid of merit and is accordingly dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
