THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.1883 OF 2017 ORDER:

This criminal petition, under Section 439(1)(b) of Cr.P.C., is filed by the petitioners/A-1 & A-2 to relax the condition imposed by the Metropolitan Sessions Judge-cum-Special Judge to Try the Offences under NDPS Act, Visakhapatnam, in Crl.M.P.No.486 of 2017, dated 21.02.2017, whereby the learned Metropolitan Sessions Judge while enlarging the petitioners on bail imposed a condition to furnish fixed deposits for an amount of Rs.1,00,000/- each drawn in the name of the court besides execution of bond for Rs.1,00,000/- each with two sureties each.

According to the petitioners, the condition of furnishing fixed deposits for an amount of Rs.1,00,000/- is onerous. However, the petitioners are allegedly indulged in ganja business and in case the said condition is relaxed to a minimum extent, they may not bother to forego the deposit and thereby, there is every possibility of fleeing away from justice, avoiding trial. Therefore, considering the facts and circumstances of the case and the financial condition of the petitioners, the condition of furnishing fixed deposits for an amount of Rs.1,00,000/- by each of the petitioners is reduced to Rs.50,000/- (Rupees fifty thousand only) each.

With the above modification, the Criminal Petition is allowed. Miscellaneous Petitions, if any, pending in this criminal petition shall stand closed.
