This criminal petition is filed, under Section 482 of the code of Criminal Procedure, 1973, by the petitioners/ A1 and A2 seeking to quash the proceedings against them in C.C.No.1298 of 2010 on the file of the I Additional Chief Metropolitan Magistrate, Visakhapatnam, registered for the offence under Section 498A IPC.

The de facto complainant is the wife of A1. On her complaint, the police of Visakhpaatnam II Town Police Station, registered a case in Crime No.70 of 2010 and after investigation filed charge sheet.

When the matter came up for hearing, learned counsel for the petitioner, without insisting for quashment of the proceedings, would submit that the petitioners may be given liberty to file petition before the trial court seeking discharge. 4.
While giving liberty to the petitioners to move an application seeking their discharge by taking all the pleas that are legally permissible to them, this petition is disposed of. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
