THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.29658 OF 2017 O R D E R:

This Writ Petition is filed questioning the action of the respondents 2 and 3 in interfering with the peaceful possession and enjoyment of the petitioner's land admeasuring 702 sq. yards situated in Sy.Nos.79 and 80, Chinnatokatta Village, Bowenpally, Secunderabad as illegal and arbitrary.

The dispute is in relation to the land admeasuring 702 sq. yards situated in Sy.Nos.79 and 80, Chinnatokatta Village, Bowenpally, Secunderabad and both the petitioner and the 7th respondent claim right over the property.

When the matter has come for hearing, learned Government Pleader for Home (T.S.) had initially placed on record the written instructions received from the Sub Inspector of Police, Bowenpally Police Station on 7.9.2017 wherein it was stated that a Crime No.251 of 2017 was registered under Sections 447, 507 IPC and Section 5(A) of the Land Grabbing Act on 21.08.2017 against one Mr. K. Laxman Goud and others.

In the context of the complaint received, the Station House Officer summoned the petitioner for the purpose of eliciting the information and to get the answers to certain questionnaires. However, the petitioner approached the Court on mere apprehension and to prevent any action being taken in relation to the complaint lodged by the 7th respondent. It is further stated that though the petitioner had lodged a complaint on 17.08.2017, no action was taken so far. The fresh instructions issued to the learned Government Pleader wherein there is no denial of the complaint made by the petitioner on 17.8.2017. However, the Station House Officer had asserted that the complaint does not disclose any cognizable offence and necessary entry in the General

Diary has been made. It is also further asserted by the Station House Officer that there is no interference by the police. In those circumstances, the writ petition is disposed of leaving it open to the petitioner to work out his remedies in relation to his complaint dated 17.8.2017 and in relation to the Crime No.251 of 2017 registered under Sections 447, 507 IPC and Section 5(A) of the Land Grabbing Act on 21.08.2017 against one Mr. K. Laxman Goud and others.

Consequently, the miscellaneous Applications, if any shall stand closed.
