THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 17340 of 2015 ORDER:
This Writ Petition assails the refusal by the Registration Authorities to register the documents presented by the petitioners in relation to their lands in Survey Nos.515 and 516 of B.K. Palli Village on the ground that the said lands are assigned lands. The status of the land in these survey numbers fell for consideration before this Court in W.P.No.19480 of 2014. A copy of the order dated 14.07.2014 passed therein is placed on record and it reflects that this Court, taking into account the fact that the land was assigned as long back as in the year 1926, opined that the prohibition contained under Section 22-A(1)(a) of the Registration Act, 1908, would have no application to the subject assignment. The said writ petition was therefore allowed.
In terms of the aforestated order and for reasons alike as were mentioned therein, this Writ Petition is allowed directing the SubRegistrar, Madanapalle, Chiitoor District, to receive the documents presented by the petitioners in respect of Plot Nos.7 and 28 in Survey Nos.515 and 516 of B.K. Palli Village, Chittoor District, and process the same for registration, without treating the aforesaid land as assigned land. However, it is made clear that it is open for the Registering Authority to verify whether the documents presented by the petitioners are in accordance with the provisions of the Registration Act, 1908 and the Indian Stamp Act, 1899.
Pending Miscellaneous Petitions shall stand closed in the light of this final order. No order as to costs.
