THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.10629 of 2017 ORDER:

This writ petition is filed challenging the action of respondent No.2 in interfering with the civil disputes by calling the petitioner to the Police Station frequently at the instance of respondent No.3. It appears that there is a marital dispute between the petitioner and respondent No.3 and on the complaint, dated 03.06.2016, lodged by respondent No.3, a case in Crime No.391 of 2016 was registered against the petitioner. The petitioner was enlarged on bail. The petitioner states that the children are with respondent No.3 and she is harassing them. When he lodged a complaint with the Station House Officer, Chilakalaguda, Hyderabad, respondent No.3 was called to the Police Station and the children expressed their willingness to stay with him. Thereafter, respondent No.3 did not visit the Police Station. The petitioner further states that the Police are interfering in the matter of custody of the children due to the influence of respondent No.3 and he being a Central Government employee, facing lot of problems.

Since the dispute relates to the custody of the children, it is open to the petitioner as well as respondent No.3 to approach the Family Court concerned for appropriate relief. There is no evidence of interference of respondent No.2 in the matter of custody of the

children. However, in view of the apprehension expressed by the petitioner, it is made clear that respondent No.2 shall not interfere with the civil disputes, except investigating into Crime No.391 of 2016 registered by the Station House Officer, Javhar Nagar Police Station. It is also made clear that this order will not prevent the police from investigating into the complaint, if any, lodged against the petitioner.

The writ petition is accordingly disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ________________________ A.RAMALINGESWARA RAO,J Dt:03.04.2017 kdl
