THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.16235 OF 2012 ORDER:

The writ petition is filed seeking a writ of mandamus declaring the action of the second respondent in issuing notice letter No.337/5/5/TPS/RW/C8/GHMC/2012, dated 04.05.2012, in respect of property bearing Municipal No.5-5-337, situated near Ek Minar Masjid, Nampally, Hyderabad, as illegal and arbitrary, and consequently direct the respondents not to dispossess the petitioner from property bearing Municipal No.5-5-337, situated near Ek Minar Masjid, Nampally, Hyderabad, without following due process of law. Heard and perused the material.

Learned counsel for the petitioner submits that the petitioner is the owner of the property bearing Municipal No.5-5-337, situated near Ek Minar Masjid, Nampally, Hyderabad, and in response to the notice, dated 04.05.2012, the petitioner attended the second respondent and produced relevant documents. However, the respondents state that the said property is the Government property and as such, the petitioner is asked to vacate the premises. He further submits that the respondents are not following due process of law.

Considering the facts and circumstances of the case, the respondents are directed to follow due process of law while dispossessing the petitioner, if the petitioner is in possession of the subject property. The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 30.01.2017 pln
