ORDER:

The grievance of the petitioner in this Writ Petition is that respondent No.1 has not been considering his representation, dated 19.12.2013, for appointing him as permanent Mutawalli for Dargah Takiya Mahaboob Ali Shah (RH).

Mr. M.A.Mujeeb, learned Standing Counsel for the Telangana State Wakf Board, appearing for the respondents, submitted that there are serious allegations of mismanagement of Wakf against the petitioner. He has

further submitted that one Ghulam Gareeb Nawaz Khan was the permanent Mutawalli for the above-mentioned Durgah; that the petitioner being the tenant of the Wakf has mislead respondent No.1-Wakf Board and got himself appointed as Mutawalli temporarily for a period of three years, which is expiring on 02.01.2016; that one Shah Nawaz Khan, son of the permanent Mutawalli, has also made a representation to respondent No.1 for appointing him as permanent Mutawalli; and that an enquiry has already been held in this regard.

In the light of the above-noted submissions of the learned Standing Counsel, without delving into the correctness or otherwise of the rival claims of the parties, this Court is inclined to direct respondent No.1 to consider the rival claims of the petitioner and Shah Nawaz Khan for appointment as permanent Mutawalli for the abovementioned Durgah, take a decision and communicate the same to the said parties within four weeks from the date of receipt of a copy of this order.

Subject to the above directions, the Writ Petition is disposed of.

As a sequel to disposal of the Writ Petition, WPMP.No.54739 of 2015 shall stand disposed of as infructuous.
