HON'BLE Dr.JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No. 8317 of 2018 ORDER :

The petitioners are accused 2 and 4 among 7 accused of Crime No. 418 of 2018 registered for the offences punishable under Sections 448, 307, 427 read with 34 IPC of Uppal Police Station of the Cyberabad Commissionarate. The petitioners are seeking anticipatory bail. 2.

One of the so called changed circumstances relied by filing as additional material in USR No.65905 of 2018 dated 27.08.2018 is the filing of charge sheet by police in this case. In fact, by a detailed common order of this Court in Criminal Petition No.5849, 5703 and 5706 of 2018, dated 20.06.2018, it was categorically observed, particularly in paragraph No.5, internal page 2, last lines that " this is not a fit case to grant anticipatory bail to A.2, A.4, A.6 and A.7 but for to the injured- A.3 and by considering the fact that A.1 and A.5 are in judicial custody since 04.05.2018, A.3 is entitled for anticipatory bail and A.1 and A.5 are entitled to concession of regular bail.

It is brought to the notice of the Court that subsequently A6 and A7 - the juveniles, were enlarged on bail. In fact, once that is the observation of not a fit case to grant anticipatory bail that too by this Court, this Court is not convinced to consider for grant of anticipatory bail but for to say remedy is left open to surrender and move for regular bail being entitled as others are already granted regular or anticipatory bail referred supra.. 4.

With these observations rather dismissal this criminal petition is disposed of giving liberty to the petitioners to surrender before the learned Magistrate concerned and move for regular bail, with notice to the public prosecutor, before the learned Sessions Judge and file affidavit of

surrender in proof to grant bail with necessary conditions by the learned Sessions Judge - preferably on same day.
