THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.19948 of 2015 ORDER:

Heard the learned Counsel for the petitioner and the learned Government Pleader for the respondents.

The petitioner is the Managing Director of Oil Company running under a licence issued under the provisions of Andhra Pradesh Petroleum Products (Licensing Regulation of Supplies) Order, 1980. The licence is valid up to 31.12.2016. While so, the Deputy Tahsildar inspected the petitioner's premises on 25.06.2015, conducted a panchanama and seized the stock. The present Writ Petition is filed seeking release of the said stock.

The stock was seized on 25.06.2015 under a cover of panchanama and proceedings are yet to be taken in respect of the irregularities committed by the petitioner. However, since the seized stock is Motor Spirit and High Speed Diesel, the said stock can be released without affecting the enquiry proposed against the petitioner. In the circumstances, the second respondent is directed to release the seized stock on the petitioner furnishing a bank guarantee to the value of the seized stock to the satisfaction of the second respondent, within a period of fifteen days from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
