HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION NO. 1871 OF 2015 ORDER:

At the admission stage, the following order is passed. In view of the prima facie accusation contained in the FIR against petitioners/A3 to A5 for the offences under Sections 120-B, 143, 193, 196, 427, 465, 471 and 474 of IPC, it is not an appropriate stage to quash the proceedings. Therefore, the investigation shall go on. However, the Police of Eluru Rural Police Station, Eluru, West Godavari District, are directed to strictly follow the procedure contemplated under Section 41-A Cr.P.C towards petitioners/A3 to A5 during the course of investigation. Petitioners/A3 to A5 shall cooperate with the investigating agency for smooth completion of investigation.

Accordingly, the Criminal Petition is disposed of. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
