THE HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY WRIT PETITION No.29221 of 2015 17.11.2015 Between:

Mugada Suramma and another .. Petitioners and The State of Andhra Pradesh, represented by its Principal Secretary, Endowments Department, Hyderabad and others .. Respondents Counsel for the petitioners: Mr.R.Siva Sai Swaroop Counsel for the respondents: Assistant Government Pleader for Endowments (AP) The Court made the following:

ORDER:

The petitioners, who claim to be the owners of lands admeasuring Acs.2.25 cents in survey No.296/4 of Dakamarri Village, Bheemunipatnam Mandal, Visakhapatnam District, filed this writ petition apprehending their dispossession by the Endowments Department.

Except the ipsi dixit of the petitioners that the Endowments Department is trying to dispossess them, no material in support thereof has been filed. If the petitioners faced threat of illegal dispossession, the least that is expected of them is to cause notice served on the person who is seeking to dispossess them. As no such notice has been served, I am not inclined to entertain this writ petition at this stage.

If the petitioners apprehend dispossession, they are permitted to send a legal notice to the authority concerned requesting them to refrain from doing so. In spite of such notice, if the petitioners face threat of dispossession, they shall be free to avail appropriate remedy to protect their possession in accordance with law. Subject to the liberties given to the petitioners as above, the Writ Petition is disposed of.

As a sequel to disposal of the Writ Petition, W.P.M.P.Nos.37867 and 38669 of 2015 shall stand disposed of as infructuous.
