HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.15233 OF 2016 ORDER:

This writ petition is filed to declare the action of the 3rd respondent in passing refusal order pertaining to the subject land purchased by the petitioner, as illegal and arbitrary.

Heard both sides.

It is stated by learned counsel for the petitioner that in similar circumstances, in WP.No.13298 of 2016, dated 20-04-2016, this Court set aside the impugned order and directed the registration authorities to reconsider it afresh to register the document in the light of decision of this Court in District Collector, Anantapur District v. M.Sadasiva Reddy[1]. The same is not disputed by the learned Assistant Government Pleader for Revenue.

Following the same and for the reasons stated in the order dated 20-042016 passed by this Court in WP.No.13298 of 2016, the impugned order is set aside and the matter is remitted back to the respondents to reconsider afresh to register the document submitted by the petitioner in the light of the decision of this Court referred to above within a period of four weeks from the date of receipt of a copy of this order and 3rd respondent shall communicate his decision thereon to the petitioner within the above time. With the above observations, the Writ Petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
