This criminal petition filed under Section 438 Cr.P.C. by the petitioner/A.2, among three accused, in Crime No.779 of 2018 of L.B.Nagar Police Station, Rachakonda Commissionerate, registered for the offences punishable under Sections 307, 448 and 504 read with 34 IPC, dated 02.07.2019, on the report of the de facto complainant, for herself, her son and husband were allegedly beaten by the accused persons with iron rod and pipe.

Heard learned counsel for the petitioner and learned Public Prosecutor, representing the State, and perused the material on record. 3.

A.1 was arrested and A.2 and A.3 are shown in abscondance from the remand report of A.1, dated 03.07.2018. The wound certificate issued by the Medicare Hospital, L.B.Nagar, shows, no doubt, the injuries are simple in nature, each of the de facto complainant, her son and her husband sustained simple one injury. It is the contention there from by the learned counsel for the petitioner/A.2 that besides, A.2 is a lady, no offence under Section 307 IPC attracts and it is a false implication and the learned Sessions Judge did not properly consider the earlier anticipatory bail application filed in Crl.M.P.No.3097 of 2018, dated 27.07.2018 and Crl.M.P.No.2842 of 2018, dated 13.07.2018, respectively. 4.

Learned Public Prosecutor opposed the same.

A perusal of the material, though there is force in the contention of the learned counsel for the petitioner of Section 307 IPC attracting is doubtful, not a case of to grant anticipatory bail. However, it will not take away liberty to surrender and move for regular bail. 6.
