THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.24393 OF 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the inaction of respondent Nos.2 to 7 in taking the necessary steps to dismantle the permanent building structure made by respondent No.8 on the 30 links road earmarked for the use of general public, in the layout approved by respondent No.5 on 09.06.1995 in Survey No.443/1 to 4 and Survey No.447/2 to 4 of Chinna Cumbum Village, Cumbum Mandal, Prakasam District, Andhra Pradesh, despite of representations made by the petitioner on 03.06.2016, 06.06.2016 and 27.06.2016 as illegal, contrary to law, and against the principles of natural justice. Heard the learned counsel for the petitioner, the learned Government Pleader for Panchayat Raj and Rural Development and Sri G.Seshadri, the learned Standing Counsel for Z.P.P. - M.P.P. - G.P.P.
It is the case of the petitioner that respondent No.5 allotted house site (Plot No.136) in an extent of Ac.0.04 cents in Survey No.447/2 of Chinna Cumbum Gram Panchayat, Cumbum Mandal, Prakasam District in favour of the petitioner and she constructed a house in the site allotted to her. The further case of the petitioner is that respondent No.8, who was allotted plot No.144, encroached the road margin and constructed a house.
A perusal of the record reveals that the petitioner submitted representations to respondent Nos.1 to 6 to take appropriate action against respondent No.8. On 24.06.2016 respondent No.4 issued a memo directing respondent No.6 to take appropriate action in this regard.
The only grievance of the petitioner is that respondent No.6 has not taken any action against respondent No.8 in pursuance of the Memo issued by respondent No.4.
Taking into consideration the facts and circumstances of the case, respondent No.6 is hereby directed to dispose of the representation of the petitioner dated 30.6.2016 in pursuance of the Memo dated 24.6.2016 issued by respondent No.4, as expeditiously as possible, preferably within a period of one (1) month from the date of receipt of a copy of this order.
Accordingly, the Writ Petition is disposed of. No costs. Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
