THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION NO.748 of 2015 ORDER:

Upon hearing both sides, at the admission stage, the following order is passed:

The allegations against the accused as per FIR No.12/2015, dated 13.01.2015, of Nuzvid Town P.S are that the petitioner/accused while working as Sub Post Master of Dum Dum gardens sub post office, Nuzvid, has collected the deposit amount from the RD deposits and made entries in their pass books, but not accounted for the amounts collected by him into the Government Accounts, immediately on the date of transaction and credited belatedly and thus misappropriated an amount of Rs.21,000/- and odd. Learned Public Prosecutor submits that the investigation is pending.

Having regard to the prima facie case and gravity of the matter, it is not a fit case to quash the proceedings. However, considering the submission of the learned counsel for the petitioner that the petitioner is now working as Postal Assistant at Dum

Dum Gardens, Nuzvid Post Office, the police of Nuzvid P.S are directed not to arrest the accused during the course of investigation. The petitioner is directed to cooperate with the investigating agency for smooth completion of investigation.

Accordingly, this petition is disposed of.

As a sequel, miscellaneous petitions, if any, pending shall stand closed.
