It is the case of the petitioner that one Kumara Swamy and two others acquired right, title and possession over the land admeasuring Ac.0.80 cents in Ward No.5, T.s.No.27 and Ac.1.50 cents out of Acs.8.20 cents in Sy.No.100, situated in Hindupuram Village and Mandal, Ananthapuram District, through registered sale deed document No.2047/2011, dated 24.02.2011, executed by the Additional District Judge, Ananthapuram, pursuant to the execution proceedings in E.P.No.6 of 2010 in O.S.No.45 of 2010 on the file of the Court of the Additional District Judge, Ananthapuram. The petitioner purchased the said property from Kumara Swamy and presented the sale deed for registration before the 3rd respondent on 31.12.2015 by paying necessary charges enclosing the copy of the link document executed by the Civil Court. Though the 3rd respondent received the document, examined the right and title over the subject property, processed the same on 31.12.2015 vide C.S.No.12035 of 2015, but did not release the same, without assigning any reasons. Aggrieved by the same, present writ petition is filed.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

Since it is stated that the 3rd respondent received the sale deed for registration, the 3rd respondent is directed to consider and register the sale deed, if the same is otherwise in order as per

the Indian Stamp Act, 1899, within a period of four (4) weeks from the date of receipt of a copy of this order. If the 3rd respondent wants to refuse the registration, he has to record reasons as envisaged under Section 71 (1) of the Registration Act, 1908. Accordingly, this writ petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this writ petition shall stands closed. ____________________________ A.RAJASHEKER REDDY, J 01.09.2016 kvs
