The petitioners pray for the following relief:- "....to declare the proceeding No.AP/RO/HYD/ Recovery/Spl.
Recovery Drive/2012/849 of the 2nd respondent dated 03-09-2012 as illegal, arbitrary and violative of Article 21 of Constitution of India apart from being violative of principles of natural justice and the provisions of Employees Provident Fund and Miscellaneous Provisions Act, 1952 and consequently set aside the same...." Mr.T.Venkat Reddy, Standing Counsel, submits that the petitioners have to avail the remedy of appeal available against the impugned proceedings and the writ petition is not maintainable. Counsel for petitioners requests the Court to permit the petitioners to avail the remedy of appeal and dispose of the writ petition accordingly.
Having regard to the above submissions, the writ petition is disposed of by granting liberty to petitioners to avail the remedy of appeal against the impugned proceedings. No order as to costs.
