Chakali. Narayana v. Lok Adhalath Bench
THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE N.BALAYOGI WRI T PETI TI ON No.2865 of 2017 ORDER: (per SK,J) The petitioner is a signatory to the Award passed by the Lok Adalat Bench at Gadwal in Lok-Adalat Case Number 13 of 2016 in M.V.O.P.No.18 of 2015 on the file of the learned III Additional District Judge, Gadwal. The grievance is with regard to the condition that the amount of Rs.7,00,000/- deposited by M/s.Bajaj Allianz General Insurance Company Limited should be kept in a fixed deposit in the name of the petitioner herein for a period of three years. The Award only permitted him to enjoy the interest arising out of this deposit every month. Learned counsel would contend that this is a harsh condition as the petitioner is prevented from enjoying his own money. However, having signed the Award knowingly, it is not open to the petitioner to maintain a writ petition against the compromise recorded by way of the said Award.
The writ petition is therefore utterly misconceived and is accordingly dismissed.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
