THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.13366 of 2024 ORDER:

Seeking the Court to enlarge the petitioner who is arrayed as accused No.3 in Crl.M.P.No.541 of 2023 in Crl.A.No.125 of 2023 on the file of the learned III Additional District Judge-cum-II Additional Metropolitan Sessions Judgecum-Principal Family Judge, Medchal Malkajgiri at Kukatpally, on bail, the present Criminal Petition is filed. 2.

Heard Sri D.Y.L.N. Charyulu, learned counsel appearing on behalf of the petitioner as well as Sri Syed Yasar Manoon, learned Additional Public Prosecutor appearing on behalf of respondent No.1-State.

Learned counsel for the petitioner submitted that the Petitioner/accused No.3/Appellant No.3 in CRLA.No.125 of 2023, seeks regular bail. The Petitioner was remanded to judicial custody on 24.08.2024, for non-compliance with a condition imposed on 22.12.2023. He further submitted that the Petitioner claims no involvement in the disputed cheque transaction, despite being a partner of accused No.1. The trial

Court imposed a 6-month simple imprisonment sentence and compensation of Rs.19,00,000/-. The Petitioner has been in jail for 52 days and requires bail to attend the death ceremonies of her father-in-law. She assures compliance with Court conditions, production of sureties, and intends to prove her innocence during appeal. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition.

After considering the submissions made by the learned counsel for the petitioner and reviewing the record, the trial Court suspended the sentence conditional upon paying 10% of the cheque amount, but the petitioner failed to comply, leading to a Non-Bailable Warrant and imprisonment. The petitioner was sentenced to six months imprisonment and directed to pay Rs.19 lakhs compensation.

In view of the facts and circumstances of the case, it appears that the petitioner is in jail from 24.08.2024. Having completed the half of the sentence since 24.08.2024, this Court deems it fit to grant bail to the petitioner conditionally. 6.

Accordingly, the Criminal petition is allowed and the concerned jail authorities are directed to release the

petitioner/accused No.3, on bail, subject to the condition that the petitioner/accused No.3, executing a personal bond for a sum of Rs.5,000/- (Rupees Five Thousand Only) with one (01) surety to the satisfaction of learned Principal Junior Civil Judge-cum-XI Additional Metropolitan Magistrate, MedchalMalkajgiri District at Kukatpally. Miscellaneous applications, if any pending, shall stand closed.
