THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.36164 OF 2015 ORDER:

Heard learned counsel for the petitioners and learned Government Pleader for Revenue.

The 1st petitioner is the defendant and the 2nd petitioner is the plaintiff in O.S.No.1184 of 2014 on the file of XIII Additional District Judge, Ranga Reddy District. The 1st petitioner presented a sale deed for registration in favour of her vendee. The said document was admitted and kept pending under Pending Document No.189 of 2015 by the Sub-Registrar, Balanagar, Ranga Reddy District, the 2nd respondent.

Since no reasons are forthcoming for keeping the document pending, learned Government Pleader for Revenue was required to get instructions. Today, learned Government Pleader, on instructions, submits that on account of pendency of O.S.No.1184 of 2014 and the orders passed in I.A.No.397 of 2014 in the said suit, dated 03.11.2014, the document was kept pending. Subsequently, he also states that the said suit has been disposed of under the Award of Lok Adalat, dated 08.09.2015, whereunder as per the terms of the Award, a compromise between the parties was recorded and in pursuance thereof, the 1st petitioner agreed to execute the sale deed on receiving the balance sale consideration in favour of the plaintiff in the suit.

The plaintiff as well as the defendant are, thus, arrayed in this Writ Petition as petitioners 1 and 2. In view of the said compromise and the disposal of the said suit, the 2nd respondent shall examine the pending document in question in terms of the Award of Lok Adalat and if the same is in accordance with the Registration Act, 1908 and the Indian Stamp Act, 1899, register and release the same in accordance with the due procedure after examining the same.

The Writ Petition is accordingly disposed of. There shall be no order as to

costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
