THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.11608 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/accused in Crime No.268 of 2023, on the file of Madhuranagar Police Station, Hyderabad, registered for the offence punishable under Section 8 (c) r/w 20 (b) (ii) (B) of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act').

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondentState and perused the record. 3.

On 26.10.2023, the Additional Inspector of Police, Madhuranagar apprehended this petitioner for being in possession of 2 kgs. of ganja. The procedure prescribed under NDPS Act was followed and he was produced before the learned Magistrate and was sent to judicial custody.

Learned counsel appearing for the petitioner would submit that ganja seized is intermediary quantity and the petitioner is ready to abide by any of the conditions imposed by this Court in the event of granting bail. 5.

On the other hand, learned Additional Public Prosecutor would submit that there are 24 other cases pending against this petitioner. However, one of the case is under NDPS Act.

Since the contraband seized is 2kgs. of ganja, which is intermediary quantity, this Court deems it appropriate to grant the relief of regular bail, subject to following conditions:- i) The petitioner/accused shall execute personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties, for a like sum each to the satisfaction of XIV Additional Chief Metropolitan Magistrate, Hyderabad at Nampally. ii) The petitioner/accused after release shall appear before the concerned Station House Officer at 10:00 a.m. everyday for a period of one

month and thereafter, as and when required for the purpose of investigation.

iii) The petitioner/accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
