HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.3853 OF 2017 ORDER:

A request is made for grant of anticipatory bail, under Section 438 of the Code of Criminal Procedure, 1973, by the petitioners viz., Dasari Durgamma and Dasari Siva Kumar, respectively, in Crime No.331 of 2016 of Nagarampalem Police Station, Guntur, Guntur District.

2. The petitioners are arraigned as accused Nos.2 and 4. They alleged to have committed the offence punishable under Section 306 read with 34 of Indian Penal Code, 1860.

3. Sri Nuthalapati Krishna Murthy, learned counsel for the petitioners, while pleading innocence and false implication of the petitioners, would submit that petitioner No.1 is working as Sweeper in Municipality and that she did not directly participate in either abetting the commission of suicide or in any way uttering anything against the deceased viz., Gandhasiri Nagaraju, who is no other than her son-in-law.

4. The learned Additional Public Prosecutor for the State of Andhra Pradesh would resist the request pointing out the relevant portions in the complaint lodged by the mother of the deceased and would submit that in the presence of the police, when they were called for mediation in connection with matrimonial life of the deceased and

Crl.P. No.3853 of 2017 ASN,J his wife, the petitioners along with accused Nos.1 and 3, who were granted regular bail, abused and insulted him (deceased), to such an extent, driving him to commit suicide.

5. Perused the complaint. What has been submitted by the learned Additional Public Prosecutor is borne out by the contents of the complaint. There is absolutely no ground to grant anticipatory bail as none of the parameters for granting anticipatory bail do occur in the present facts scenario.
