Merlaveeraveni, v. The State Of Andhra Pradesh,
HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.19934 of 2016 ORDER:
On the application made by the petitioners for grant of pattadar passbook and title deed in respect of land admeasuring Ac.2-23 cents in Sy.Nos.230/2 and 230/3 of Venkatayapalem Village, Ramachandrapuram Mandal, East Godavari District, the 2nd respondent passed order of rejection dated 28-05-2016 stating that "due to following reasons". But no reasons are found in the impugned order. The impugned order is totally without application of mind. However, learned Government Pleader for Revenue produced some written instructions and submits that there are civil disputes pending. If that is the case, atleast the 2nd respondent should have given reasons for rejection, simply they cannot reject the applications of the petitioners. In view of the above, the impugned order is set aside. The 2nd respondent is directed to pass orders afresh on the application of petitioners and take action accordingly.
The said exercise shall be done within a period of two weeks from the date of receipt of copy of this order.
With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 23-06-2016 nvl
