THE HON'BLE SMT. JUSTICE ANIS CIVIL MISCELLANEOUS APPEAL NO. 4199 OF 2004 JUDGMENT:

When the matter was called on 19.08.2016 for hearing, it was represented that the counsel for the appellant was no more, as such the name of the appellant was printed in the cause list. In spite of that nobody represented on behalf of the appellant on 02.09.2016 and the matter was directed to be posted to today under the caption 'for dismissal'. Even today also, there is no representation for the appellant. From this, it appears that he is not interested in prosecuting the matter.

Hence, the appeal is dismissed for default. No order as to costs. As a sequel, Miscellaneous Petitions, if any, pending in this appeal shall stand closed.
