HON'BLE SRI JUSTICE SURESH KUMAR KAIT And HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.27920 OF 2018 ORDER: (Oral, Per Hon'ble Sri Justice Suresh Kumar Kait) Vide the present Petition, the petitioner has challenged the order, dated 31.07.2018, passed in O.A. No.1515 of 2018 by the Andhra Pradesh Administrative Tribunal at Hyderabad (for short, 'the Tribunal'); whereby the O.A. filed by the petitioner, under Section 19 of the Administrative Tribunals Act, 1985 (for short, 'the Act'), has been dismissed.

The petitioner is working as Town Planning Officer in Chilakaluripet Municipality of Guntur District. He challenged the action of the respondents in not promoting him to the post of Assistant Director of Town and Country Planning due to minor punishment of censure issued in G.O.Rt. No.682, dated 25.09.2017. Admittedly, the currency of that punishment would continue up to 24.09.2018. In between if promotion is given effect, the case of the petitioner shall not be considered. Moreover, it is not the case of the petitioner that any of the junior to him is given promotion to the post of Assistant Director of Town and Country Planning, subsequent to issuance of G.O.Rt. No.682, dated 25.09.2017. Hence, we find no illegality or perversity in the order dated 31.07.2018 passed in O.A. No.1515 of 2018.

Finding no merit in the present Petition, the Writ Petition is, accordingly, dismissed. No costs.
