THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.2297 OF 2016 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

The petitioner questions the action of the Tahsildar, Chintalapudi Mandal, West Godavari District, the 3rd respondent, in including his land in the list of prohibited category communicated by the revenue authorities to the Sub-Registrar, Chintalapudi, West Godavari District, the 2nd respondent and the action of the 2nd respondent in refusing to entertain the sale deed for registration. The issue is no more res integra in view of the Full Bench decision of this Court in W.A.No.343 of 2015 and batch dated 23.12.2015, whereunder inter alia the respondent - State was directed to revise and submit a fresh list of lands in the prohibited category.

Since the said exercise is required to be taken up by the State Government within the time stipulated, it is appropriate to permit the petitioner to file his objections before the District Collector with regard to the existing list of lands whereunder his lands are included and seek redressal of his grievance. While complying with the directions of the Revenue Divisional Officer, the District Collector shall take into consideration the objections of the petitioner and take appropriate decision and then communicate the same to the petitioner. The Writ Petition is accordingly disposed of. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
