HONB'E SRI JUSTICE CHALLA KODANDARAM WRIT PETITION No.14522 OF 2017 ORDER:

The writ petition is filed challenging the action of the respondent in not transferring the ownership of the Mobile Crane bearing Registration No.NL01 A.8816 pursuant to the application of the petitioner dated 13.01.2016 and keeping the said application pending without assigning any valid reasons. It is the specific case of the petitioner that in order to carry on the business of the petitioner firm, the petitioner purchased a Mobile Crange frm M/s. Trans India Services Pvt Limited and obtained No Objection Certificate from the concerned registering authority as early as on 17.11.2015 for transfer of the said vehicle in the name of the petitioner. It is further stated that consequent upon the said NOC issued by the R.T.O Kohima, Nagaland dated 17.11.

2015, after bringing back the said vehicle from Nagaland State to the place of business of the petitioner, the petitioner made an application before the 2nd respondent on 13.01.2016 for transfer of the said vehicle in the name of the petitioner along with all the relevant documents, but the respondent authorities did not take any steps so far. Hence, the present writ petition.

Inasmuch as the grievance of the petitioner is for consideration and disposal of his representation/application dated 13.01.2016, the writ petition is disposed of without expressing any opinion directing the respondents to consider the representation/application dated 13.01.2016, submitted by the petitioner and pass appropriate orders in accordance with law, within a period of six weeks from the date of receipt of copy of this order. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
