THE HON'BLE SRI JUSTICE N.TUKARAMJI CRIMINAL PETITION No.10323 OF 2021 ORDER:

This criminal petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 seeking regular bail by petitioner/A1 in connection with Crime No.162 of 2021 on the file of C.C.S. Hyderabad, registered for the offence punishable under Sections 406 and 420 of the Indian Penal Code, 1908. 2.

Learned counsel for petitioner/A1 submits that the petitioner/A1 is in judicial custody since 72 days and no charge sheet is filed so far. The other accused in the crime on the self-same allegations were not arrested, thus the investigating agency had acted against the petitioner/A1 with reservation.

Per contra, learned Additional Public Prosecutor opposed the petition and submits that two other crimes are pending against petitioner/A1 with the similar allegations and there are so many victims. He further submits that there are some more witnesses to be examined in this case.

Having regard to the duration of judicial custody undergone by the petitioner/A1 and the reported stage of investigation, this Court is of the opinion that the prayer of the petitioner for grant of bail deserves positive consideration.

The Criminal Petition is accordingly allowed. The petitioner/A1 shall be enlarged on bail in connection with Crime No.162 of 2021 on the file of C.C.S. Hyderabad, on his executing a personal bond for a

sum of Rs.50,000/- (Rupees fifty thousand only) with two sureties for a like sum each to the satisfaction of the XII Additional Chief Metropolitan Magistrate, Hyderabad. The Petitioner/A1 shall furnish his contact and residential particulars to the Station House Officer, C.C.S. Hyderabad and shall also appear on every Sunday between 10.00 A.M. and 1.00 P.M. till completion of trial and shall cooperate in the investigation. If the petitioner fails to abide by any of the conditions above, the respondent is at liberty to initiate appropriate proceedings for cancellation of bail.
