THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.43922 of 2016 ORDER:

The petitioner states that he is the absolute owner and possessor of land admeasuring Ac.3-18 cents in Sy.No.189/1 situated in Komaravolu village, Pamarru Mandal, Krishna district. It appears that respondents 3 and 4 wanted to take possession of Ac.1-18 cents in Sy.No.189/1 on the ground that they required it for the purpose of burial ground. A Gram Sabha was held on 10-12-2016, wherein the petitioner strenuously opposed the forcible dispossession. In respect of the same, the petitioner apprehends that respondents 3 and 4 may take possession of the land without following any due process of law.

As per the averments in the affidavit filed in support of the writ petition it is clear that the petitioner acquired the said land under registered sale deeds and there is no dispute with regard to the title of the land. If the respondents 3 and 4 want any part of the property of the petitioner, which is his private property, for a public purpose, they had to take recourse of law.

In the circumstances, this writ petition is dispose of, directing the respondents 2 to 4 not to interfere with the

possession of the petitioner's property without following due process of law.

The writ petition is accordingly disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in the Writ Petition shall stand closed.
