THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1378 of 2015 ORDER:

1. This Criminal Revision Case is filed by the petitioner challenging the order dated 14.3.2013 passed in Crl.M.P.No.868 of 2013 in P.R.C.No.14 of 2013 on the file of the Chief Metropolitan Magistrate, Cyberabad.

2. The 2nd respondent, who is the victim in the above P.R.C., is the daughter of the petitioner. It is alleged that the 2nd respondent was raped by the accused, who is her step father. The petitioner, who is the natural mother of the 2nd respondent and who is L.W.4, filed the above Crl.M.P seeking custody of the 2nd respondent. The Court below rejected the above Crl.M.P. Hence, the petitioner filed the present revision.

3. Learned Counsel for the petitioner submitted that the petitioner is not living with the person, who committed the offence and that the petitioner is willing to take care of the 2nd respondent. Further, he informed that the petitioner will depose in the court regarding the facts of the case.

4. Considering the facts and circumstances of the case, the custody of the 2nd respondent is given to the petitioner on condition of the petitioner executing a personal bond for a sum of Rs.5,000/- (Rupees Five thousand only) to the satisfaction of the Court below and filing an affidavit before the Court below informing that she will take care of the 2nd respondent and also appear before the Court along with the 2nd respondent to depose in the above case. Further, the petitioner is directed to allow the authorities of Prajwala home, as and when they

want to visit her house.

5. Accordingly, the Criminal Revision Case is disposed of. Consequently, the miscellaneous petitions pending, if any, shall stand closed.
