HON'BLE SRI JUSTICE S.V. BHATT W.P.No. 41182 of 2016 O R D E R:- The petitioners, apprehending dispossession from the agricultural land in an extent of Ac.2.25 cents in R.S.Nos.11/ 1, 11/ 2 and 11/ 3 at Bheemadolu village and Mandal, West Godavari District, without completing the enquiry under A.P. Assigned Lands (Prohibition of Transfers) Act, 1977, filed the instant writ petition.

This Court, on 28.11.2016, directed the parties to maintain Status Quo as regards possession is concerned. After perusing the material available on record, this Court is of the view that the 3rd respondent issued notices under the Act 9 of 1977. The petitioners have filed explanation on 02.12.2015 and also on 01.11.2016 contesting the notices issued by the 3rd respondent.

The grievance of the petitioners is that the 3rd respondent is dispossessing the petitioners without completing the enquiry, affording opportunity to the petitioners and communicating the decision taken on the notices issued in this behalf and is expected to complete the enquiry, in accordance with law.

Therefore, the interim order granted on 28.11.2016 is made final order in the writ petition. The 3rd respondent is

SVB,J WP_41182_2016 given liberty to complete the enquiry initiated in this behalf in accordance with law.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
