HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 33568 of 2017 ORDER:

The allegation in the writ petition is that respondent No.3 (Station House Officer, Machavaram Police Station, Krishna District), is calling the petitioner over telephone in relation to the property which is the subject matter of GPA.No.1670/2003, SRO, Gunadala dated 07.04.2007 and, even assuming that there are disputes in relation to the said property, respondent No.3 has no jurisdiction to interfere with the same.

Learned Government Pleader for Home (AP), on instructions, would submit that the complaint is false and respondent No.3 has not called the petitioner to police station as no crime is registered against him. In the circumstances, the Writ Petition is disposed of making it clear that respondent No.5 shall not interfere with the property which is the subject matter of GPA.No.1670/2003, SRO, Gunadala dated 07.04.2007. It is also made clear that, unless any crime is registered, the liberty of the petitioner shall not be interfered with without following due procedure prescribed under law.
